TERMS OF SALES

1 . CONDITION OF PURCHASE


The products are intended exclusively for the personal use of the buyer, without any direct relationship with the professional activity of the latter.


2 . PRODUCT / PRICE

PRODUCED

The products offered for sale on the site which may possibly be attached to it are those which appear on the site, on the day of the consultation and within the limit of available stocks.


In case of unavailability of a product, the customer is informed of this unavailability either, during the establishment of the order: a message is displayed and indicates that the desired product is temporarily unavailable, or, following the validation of the order and before delivery, by e-mail.


KEITSWIM does not have a physical store apart from its website, its instagram page @keitswim, its facebook page “KEITSWIM”, its Tiktok profile “Keitswim” and its Pinterest page “Keitswim”. All products sold by KEITSWIM are listed on the company's websites/webpages (hereinafter referred to as the "Products").
KEITSWIM does not distribute a paper catalog.

B- PRICE

The amount of the shipping costs is notified to the customer before the validation of the order.
It is specified that any promotions granted in the form of reduction vouchers are only valid for a single order and over a given period of validity and cannot be combined with other reduction offers.


KEITSWIM reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of the registration of the order, subject nevertheless to the availability of the said products.

C – CUSTOMS DUTIES

Any order placed on the site, and delivered outside the European Union, may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These taxes or any customs duties related to the delivery of an item are the sole responsibility of the customer and are his responsibility.


3 . REGISTRATION AND VALIDATION OF THE ORDER

A – TERMS OF THE ORDER

The customer views the products offered for sale on the day of consultation of the site by browsing through the different product categories.
The customer can select the products of his choice by adding them to the basket and then click on his shopping basket to see the contents of his basket displayed on the screen. The basket contains all the elements of the order and in particular the total amount excluding transport costs, the nature of the products ordered and their quantity. If the customer wishes to choose other products, he can continue his navigation on the site, being assured that the products he has just selected are well kept in his shopping basket.
The customer has the possibility, at any time of the order process - namely until the moment preceding the payment - to return to this order, complete it, modify it, cancel it and this, as long as he does not will not have been definitively validated.


Any purchase order signed with the click of validation constitutes an irrevocable commitment by the customer which can only be called into question in the case limitedly provided for in this contract in the article "Right of withdrawal".
Once the selection of products is complete, the customer can order them by validating the order. From then on, a new page will open inviting the customer to:
– enter their username (e-mail address) and password if the customer is already registered on the site;
– or accurately complete a personal data collection form by filling in the mandatory fields, in particular Surname, First Name, Email Address, Billing Postal Address, Delivery Postal Address.
The customer undertakes to complete the form made available to him in good faith. The customer acknowledges that the data he communicates to KEITSWIM and which are stored in KEITSWIM's information systems are accurate and constitute proof of his identity.
After having filled in his contact details and his delivery address, the customer is informed of the various delivery options and the amount of the shipping costs. The customer is then invited to select and validate his method of payment.
The summary of the order is displayed on the same page and includes all the information relating to this order, namely in particular the nature, quantity and price of the products, the total amount (including transport costs) of the order, billing and delivery details, delivery address and billing address.

The data recorded by KEITSWIM constitutes proof of all transactions between KEITSWIM and the customer.

B- ORDER CONFIRMATION

Once the order has been confirmed and its payment has been validated, the customer has access to a printable and recordable summary of the order, including the order references.
An order confirmation email is automatically sent by KEITSWIM to the email address provided by the customer and will include the following information:
– the reference of the order recorded at the time of placing the order,
– the summary of the order (designation of the Product(s) ordered, quantity, size, price),
– the total amount of the order, all taxes included,
- shipping charges,
– confirmation of payment.

In order to protect KEITSWIM from abusive practices operated by fraudsters, and in the event that KEITSWIM or the online payment provider suspects the fraudulent nature of an order, they reserve the right to ask the buyer ( prior to processing the order), additional documents (including proof of address and debit in the buyer's name, photocopy of the Buyer's identity card, photocopy of the Buyer's bank card) in to verify that it is not fraudulent.
In the absence of a response from the buyer within fifteen (15) days following the sending of the request by KEITSWIM or the online payment service provider, the order will be canceled and KEITSWIM will refund the this one on the bank account debited during the order.

C – PROOF OF ORDER

It is expressly agreed between KEITSWIM and the customer that e-mails will prevail between the parties as well as the automatic registration systems used on the site, in particular as to the nature and date of the order.
The customer can access, if necessary in accordance with the rules of common law, the electronic contract concluded between the buyer and KEITSWIM. To do this, he contacts Customer Service to whom he will provide all the necessary information, in particular the order number and his contact details.


4 . SECURE PAYMENT

    Payment control:
    KEITSWIM reserves the right to check the validity of the payment, before shipping
    of the order, by any means that the seller deems necessary.
    Default of Payment:
    KEITSWIM reserves the right to refuse to make a delivery or to honor an order
    from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. In case of fraud or suspicion of fraud, the seller reserves the right to remove any member without notice or compensation.

5 . DELIVERY AND RECEIPT

We decline all responsibility, once the packages have been dispatched, for the extension of delivery times due to the carrier, in particular in the event of loss of products, bad weather or strikes.
Please note that some deliveries may be subject to customs tariffs and delays.

Delivery in Metropolitan France is free from 70 euros of purchase.

A – DELIVERY TERMS

Once the order has been prepared, it will be sent to the postal address provided by the customer when ordering.


The products will be delivered according to the delivery method selected by the customer.

B - DEADLINES

In the event of an input error, in particular of delivery address resulting in a delay or impossibility of delivery, KEITSWIM cannot be held responsible. All costs related to the reshipment of products due to an input error by the customer will be borne by the latter.
Any delays on the part of the carrier do not entitle the customer to claim damages. In any event, the order will be executed within a maximum period of thirty (30) days from the day following that on which the buyer validated his order, subject to full payment of the price and compliance with the conditions of purchase. In the absence of delivery at the end of this period, the buyer will have the possibility of canceling his order.

C – LATE DELIVERY

If the maximum delivery period of thirty (30) days is exceeded, the customer may exercise his right to terminate the order with KEITSWIM Customer Service.


Any delay in delivery must be reported as soon as possible by the customer by e-mail to Customer Service so that the latter can take the necessary measures with the carrier responsible.

D – PRE-ORDERS

Items that are not yet in stock, available for pre-orders, are indicated by a mention on their product sheet with the approximate date of shipment. KEITSWIM undertakes to deliver these items within the times mentioned.
For the same order including items in stock and items available for pre-orders, the entire order is shipped at once.

E-RECEPTION

Each delivery is deemed to have been made as soon as the products are made available to the customer by the Carrier. The customer can follow the delivery of his package with a tracking number by consulting the carrier's website as well as in his personal customer area, and on the link provided to him in his order confirmation email.
It is the customer's responsibility to check immediately upon receipt of the products the conformity and integrity of the products shipped. The customer agrees to send a letter of complaint by e-mail or by post to KEITSWIM to notify damage or failure within 3 days of the date of delivery of the products.
Any anomaly/reservation identified at the time of delivery (in particular late delivery, missing or damaged product) must be reported completely and precisely by the customer on the receipt provided by the Carrier at the time the products are made available and/ or confirmed by registered letter to the Carrier within three (3) days of receipt of the order.
Any reservation of this type must be notified in parallel and as soon as possible to KEITSWIM Customer Service. A copy of the complaint sent to the Carrier must be attached.
If 5 working days after the shipment of the package it is still not delivered, the customer can approach the post office closest to the place of delivery to obtain a follow-up of the order. If the package cannot be located, the customer must then contact KEITSWIM through Customer Service.

6 . RETURN PROCEDURE

A- RETURN TERMS

You have 14 days from the day of delivery to make a return request for swimwear as well as ready-to-wear or accessories (within the limit of available stocks).
On the other hand, we do not accept any return request for jewelry unless they have a defect upon receipt of the product.

Once the product has been declared compliant, you will receive a credit note by email, valid for 90 days throughout the site or a refund of the order excluding postage.


Please note that we do not accept returns on orders made during promotional periods, sales and other commercial offers.
The products must imperatively be returned complete, accompanied by all the accessories, unworn, unwashed, unaltered and showing the protective strip for swimsuit bottoms or one-piece swimsuits, with their original label still attached.


We reserve the right to refuse returns that do not comply with these conditions.

B – FORCE MAJEURE

Expressly are considered as cases of force majeure, in addition to those usually retained by the jurisprudence of French courts and tribunals,
– total or partial strikes, internal or external to the company, blocking of means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer breakdowns, blocking of telecommunications including networks and in particular Internet.
The occurrence of a case of force majeure will initially suspend, automatically, the execution of the order.
If beyond a period of three (3) months, the parties note the persistence of the case of force majeure, the order will be automatically cancelled, unless otherwise agreed by both parties.

7. COMPUTER LAW AND FREEDOMS

In accordance with the Data Protection Act 78-17 of January 6, 1978 as amended, you have a right of opposition (art. 38), access (art. 39), rectification or deletion (art. 40) data that concerns you. You can exercise this right by contacting EMMA KEITMANN.

8 . COPYRIGHT


This site constitutes a work protected in France by the Intellectual Property Code, and abroad by the international conventions in force on copyright. The violation of one of the copyrights of the work is an offense of counterfeiting punishable, under the terms of article L.335-2 of the Intellectual Property Code, by 2 years of imprisonment and 150,000 € fine.
